Judgement day for Salman Khan, court to pronounce verdict in 13 years old hit-and-run case

Verdict in Salman Khan hit-and-run case to be pronounced tomorrow
New Delhi: It is indeed a crucial day for actor Salman Khan and the Hindi film industry. For within a few hours from now, Additional Sessions judge DW Deshpande will pronounce his verdict in the 2002 hit-and-run case. The 49-year-old actor, who has been busy shooting for Kabir Khan's 'Bajrangi Bhaijaan' in Srinagar, arrived in Mumbai on Tuesday evening.
Salman Khan, who enjoys a huge huge fan following, courtesy his acting skills, faces charges of culpable homicide not amounting to murder. He is accused of ramming his car into a pavement in Bandra in Mumbai in 2002 - killing one person and injuring four others and then running away from the scene of the crime.
Salman Khan, if convicted, will have to serve a jail term of maximum 10 years. In the past, Salman had told the court that he was neither drinking nor was he behind the wheel at the time of the accident.
To ensure the actor's fans don't enter the premises, police will beef up security in the court, a sessions court source has been quoted as saying. Only media persons, lawyers and the court staff would be allowed inside the court, the sources said.
Judge Deshpande has summoned the actor to remain present in the court at 11.15 AM on the day. The prosecution and defence concluded arguments on April 21 in the trial which was conducted afresh after a Magistrate added the charge of culpable homicide not amounting to murder and referred the case to the sessions court. The culpable homicide offence, which provides for punishment upto 10 years, is triable by a sessions court and not by a magistrate.
Earlier, the magistrate was trying Khan for rash and negligent driving, an offence under IPC which attracts punishment upto two years. Salman Khan, 49, pleaded he was not driving the car at the time of mishap and that his driver Ashok Singh was behind the wheel.
This has been corroborated by Singh who appeared as defence witness. However, the prosecution led by Pradeep Gharat alleged that Khan was driving after consuming 'Bacardi Rum' in a bar. The actor, on the other hand, argued he was having a glass of water and not alcohol. While prosecution pleaded that there were three persons in the car - Salman, his police bodyguard Ravindra Patil and singer friend Kamal Khan, the actor argued that there was a fourth person and he was Ashok Singh.
A court had in 2013 framed charges in a fresh trial against Khan for culpable homicide not amounting to murder. The prosecution examined 27 witnesses to prove its case. Khan's lawyer Srikant Shivade argued that post-mortem report of the deceased suggested that he had received crushing injuries and it had been caused when a crane called by police could not lift the heavy SUV in one go and dropped it on the victims.
The defence lawyer argued that the mishap had occurred as the car crashed into a shop after its left tyre had burst. He also alleged that road was being repaired near the shop where the mishap occurred and stones were scattered at that place.
The prosecution said it was relying upon the statement given by Khan's police bodyguard Ravindra Patil to police saying he had warned the actor not to drive in a rash and negligent manner but he did not heed to his advise. Patil, who passed away during the trial, had also said that Khan was under the influence of liquor when he met with the accident.
However, he had not said a word about Khan's claim that his driver Ashok Singh was behind the wheel. Salman Khan's lawyer argued that the evidence of Ravindra Patil, an eyewitness, should be discarded as he had passed away and was not available for cross examination. On the other hand, the prosecution argued his evidence should be considered as he had seen Khan driving the car and was a key witness.
The defence lawyer also argued that police had not obtained finger prints from the steering wheel to find out who was driving the car. According to the prosecution, Khan's rash driving claimed the life of Nurullah Mehboob Sharif and injured Kalim Mohammed Pathan, Munna Malai Khan, Abdullah Rauf Shaikh and Muslim Shaikh. However, Salman Khan claimed that he was not driving the Toyota Land Cruiser and it was his driver Ashok Singh who was behind the wheel.
He said, "Ravindra Patil was a liar and was sleeping in the car at the time of mishap." The defence lawyer also disputed the prosecution's claim that it took 30 minutes for Khan to drive his car from JW Marriot Hotel to the accident spot at a speed of 90 kms per hour after taking drinks on September 28, 2002.
The lawyer argued that it would not take him 30 minutes because the distance between the two destinations is not much. It would take Khan only 10 minutes, he said, adding that the prosecution's case was "false".
The prosecution also alleged that Khan was driving the car without holding a licence. It produced RTO records to show that the actor had procured a licence only in 2004, two years after the mishap. The actor, however, pleaded that this was not the first licence obtained by him. The court would also pass order on an application filed by activist Santosh Daundkar alleging that police had committed perjury (giving false evidence) by examining a wrong set of doctors and delaying the trial by three years.
The application alleged that police had not examined a key witness - Kamaal Khan, singer and friend of Khan - who was in the car along with the actor at the relevant time. Salman Khan is facing charges under provisions of IPC, Motor Vehicles Act and Bombay Prohibition Act.
He is charged under IPC sections 304 part II (culpable homicide not amounting to murder) which attracts upto 10 years in prison; 279 (rash and negligent driving) which stipulates six months jail; 337 & 338 (causing hurt by act endangering life and causing grievous hurt respectively) with punishment up to two years, and 427 (mischief causing damage to property) with maximum punishment of upto two years.
Under Motor Vehicle Act, the actor is charged with Sections 34 (a), (b) read with 181 (driving vehicle in contravention of rules) and 185 (driving at great speed after consuming alcohol). Salman Khan is also charged under sections of Bombay Prohibition Act relating to driving under influence of alcohol with maximum six months' jail.

Love birds Sania Mirza and Shoaib Malik must make the most of Jupiter’s ongoing transit through Cancer, says Ganesha.

  • After being recently crowned as the World's No. 1 in Women's Tennis Doubles, Indian tennis star Sania Mirza praised husband Pakistani cricketer Shoaib Malik for helping her take up tennis once again. Ganesha reads the couple's Charts to predict the way ahead for them.
  • After being recently crowned as the World's No. 1 in Women's Tennis Doubles, A Mills & Boon real-life couple or a jodi straight out of a magnificent, picturesque Yash Raj movie? You can call them anything, but one thing’s for sure—they have happily and very elegantly defied their detractors! Sania Mirza and Shoaib Malik—young, sporty, good looking, rich, super successful in their respective super snazzy careers, world famous—ahem—can there be anything else one may dream of!! Well, the two pretty people fell in love across borders—and didn’t let the dangling equation between their neighbouring countries come in the way of their splendid union. In 2010, the two married, and have ever since maintained their loving relationship, despite vast distance and busy careers, which often take them farther apart to lands foreign and alien. Recently, Mirza attained yet another peak in her tennis career, when she was crowned World’s Numero Uno in the Women’s Doubles Category. Sania thanked husband Malik for helping her get back to tennis again, after an injury in 2010. Elated fans, couple’s families and Indians apart, Sania’s achievement once again zooms the limelight on the couple’s chemistry and long-distance relationship. And, Ganesha takes this opportunity to take a look at the man’s and wife’s Solar Charts to predict the way ahead for them.

Ganesha observes that Shoaib Malik is born with Mercury and Saturn exchange, which bestows power and strength to this Chart. In view of the transiting planets, Ganesha notes that currently Rahu is traversing over Mars and retrograde Saturn in the talented cricketer’s Chart. Also, the transiting Jupiter will continue to aspect Shoaib’s Natal Sun, and Natally retrograde Venus and (retrograde) Mercury till 14th July 2015. Plus, the transiting Saturn will keep moving over his Natal Uranus till January 2017.

Considering these factors, Ganesha feels that Shoaib Malik shall remain in the limelight as a cricketer as well as celebrity till July 2015. However, post that time, when Jupiter moves to the Zodiac Sign Leo, Malik may experience a slow-down in his career. Between July 2015 and January 2016, he will continue to struggle in his Leagues, and his performance may come under a scanner. Nonetheless, post January 2016, Ganesha foresees a better period for Malik and his career. Overall, fluctuations shall remain a part and parcel of Pakistani cricketer’s career.

Since, Malik’s time of birth is unavailable, predicting for sure as to whether he will or will not settle down in India is not possible.
Being born with an exalted Mercury, Sania Mirza is destined to do well in the field of sports. Moreover, Saturn and Mars are in exchange in Mirza’s Chart, which is another supportive factor for her, as this planetary configuration bestows her with patience and perseverance, both qualities that can be extremely helpful for any sportsperson.
Ganesha notes that Sania is currently under the influence of Moon major period and sub period of Saturn, which will rule till 2nd July 2016. The transiting Saturn is currently passing through the Zodiac Sign Scorpio—which indicates that Sania is currently under the influence of a ‘Saturn-return Phase’. Moreover, the Rahu-Ketu half-return Phase is also ongoing for Sania. Although, these seem like difficult periods, the exalted Jupiter’s aspect on Sania’s Natal Mars till July 2015 does indicate achievements in Sania’s career, as a sports personality—and, hence her recent World No. 1 title in Women’s Tennis Doubles.
However, while Jupiter transits through the 8th House from Sania’s Ascendant (Capricorn) between July 2015 and August 2016 and forms an Opposition aspect with her Natal Jupiter, she may face troubles. This time doesn’t look set to be that great for her career in sports. However, she still would probably be making good money through other sources/activities. In the second half of 2016, other planetary transits and Dashas are favourable, so post that time again her career will start picking up, feels Ganesha.
The Relationship…
Jupiter’s transit through Cancer – its Sign of exaltation – through the 7th House (from her Ascendant) signifying public image and marriage in Sania’s Chart indicates uplift-ment in her public image and enhanced mutual understanding with her life partner. This transit of Jupiter, thus, shall be very favourable for the couple till July 2015.
From January 2016, though, Ketu a strong malefic will begun transiting through the 2nd House signifying family in Sania’s Chart. Thus, between January 2016 and July 2017, she is likely to face some sort of friction at the family front. In Shoaib’s chart, Ketu will be transiting through the 2nd House from his Natal Sun, so he too may face some friction at the family front. Thus, this will be a time when both of them will have to be careful, and not get angry or dejected over the distance between the two.
Long Distance?
In Sania’s Birth Chart, the Lord of the 7th House of marriage is posited in the 4th House, in an Opposition aspect with the retrograde Venus – the significator of love. This planetary congregation indicates that there are higher chances of this relationship remaining long distance for quite some time.
